Road Traffic Accident Compensation

Brigid O’Donnell Solicitors were pleased to secure a fair and appropriate settlement for a young school student who sustained injuries in a road traffic accident.

Our client was a restrained rear-seat passenger, travelling to school in a vehicle driven by a family member, when a car approaching from the opposite direction rounded a bend at speed and collided with their vehicle without warning. As a result of the impact, our client struck her head and suffered soft tissue injuries to her neck, shoulder, and chest.

A claim for compensation was submitted to the Personal Injuries Resolution Board (PIRB) in line with standard procedure for personal injury claims in Ireland. While the soft tissue injuries resolved within a relatively short period, our client continued to experience persistent post-concussive headaches, which impacted her daily activities and school life.

Due to these ongoing symptoms, the initial assessment of damages by the PIRB was not accepted. Court proceedings were subsequently issued to ensure that the full extent of our client’s injuries was properly recognised. Updated medical evidence was obtained, confirming the continuation of post-concussive symptoms over a longer period than initially anticipated.

Through careful case preparation and strategic negotiation, a significant settlement offer was secured. This offer was brought before the Court and approved as fair and reasonable compensation. In accordance with Irish legal practice for minor plaintiffs (individuals under eighteen years of age), the settlement funds will be held under Court control until our client reaches the age of eighteen.

Importantly, legal costs were also recovered from the opposing party.
