Compensation for contractor who fell from a ladder on a construction site

Brigid O’Donnell, Solicitor, was delighted to achieve a significant settlement for a client who suffered injuries when he was caused to fall from an unsecured ladder on a construction site in a workplace accident.
  • Our client was working as a sub contractor carrying out works on a building site at the time of the accident. He was descending a ladder when the ladder was caused to slide to the left, resulting in his falling from a significant height and fracturing his leg, due to the fact that the ladder had not been properly secured.

An application was made to the Personal Injuries Resolution Board (P.I.R.B.) in the usual course but the defendants declined to allow assessment indicating that they would not be accepting responsibility for our client’s injuries.

Despite the difficult and complex liability arguments arising, the case settled for a six figure sum without the necessity for a court appearance.

He recovered appropriate compensation for his pain and suffering, together with all of his out of pocket expenses. His legal costs were discharged by the retailer’s insurers.
