Brigid O’Donnell Solicitors were delighted to achieve a fair settlement for a client who suffered a recognisable, psychiatric injury due to bullying by his Line Manager.

Our client began to experience difficulties in his relationship with his Line Manager. He noted that he was being treated differently to other colleagues. All issues came to a head when he was subjected to a disciplinary procedure which was entirely without foundation, or merit.

He raised a grievance regarding the fact that the complaint of wrongdoing against him was entirely vexatious and that the disciplinary process was flawed. The process was immediately discontinued.

However, no attempt was made to investigate his grievance and his Line Manager continued to act in a manner which undermined his right to dignity in the workplace. He attended with his doctor and was certified as unfit for work. He was diagnosed with anxiety and depression directly linked to his working conditions. He sought advices from Brigid. He felt that a return to his workplace would have a detrimental effect on his overall health and wellbeing. His doctors were in agreement. He feared that the necessity for a lengthy court process would be too stressful and would further injure his health. He wanted to draw a line under the experience as quickly as possible and move forward with his life.

We were delighted to negotiate generous terms of severance with his employer without the necessity for the issuing of court proceedings.  All legal costs were recovered from the other side.
